Insurance rip off!

  1. Basically, I had a small accident on Friday in which an 11 year old child ran into the road causing an unavoidable accident. She went up my bonnet and her arm broke my windscreen (doing between 15-25mph at the time) Her dad called after and said she was fine and that was the end of it! So I called up to get a new windscreen and paid the £75 but as soon as they got wind of how it happened, they've removed my no claims and are coming round to take a statement etc. Apparently as the girl was under 18 it's automatically my fault, even though witnesses said it was her fault and she said it herself! I'm cacking my pants about my insurance in April and if I can't get insured on my meg then she'll have to go and I'll have to start again from the bottom which I don't want to do! Anyone been in this situation before and know what might happen because I'm really worried I'm going to end up loosing my pride and joy over something that was out of my control!

  2. Surely the facts should prevail and this gets sorted especially if there is witnesses, and if the insurance speak to the girl and her parents and they tell them it was her fault then hopefully your no claims should be the same

    glad to hear tho that both you and the little girl are okay and hopefully the situation gets resolved sensibly
     
  3. Did you contact your insurance directly or autoglass for the replacement?
     
  4. Yeah that's the main thing but I was driving safely and managed to slam on the brakes super quickly! I just don't see why I'm being made to look like the guilty party because she was under 18! Even with the windscreen claim, I was getting quotes of £1,900 from my insurance company! Might be time for the meg to go after only a year :worried:
     
  5. Sounds like they are pulling a fast one. I ran over a 14 year old lad who ran out in front of a lorry in the lane next to me. Luckily he missed the lorry but landed on my bonnet. Luckily no damage to himself or the car. It happened right outside the Police station and there were plenty of witnesses.

    A few days later I received a call from the officer in charge of the investigation saying that no action would be taken against me as it was obviously his fault but I could take action against the boys parents if there was any damage.

    I declined as the boy and his parents had already had the fright of their life
     
  6. Yeah now they're saying that although people saw this girl run at full speed infront of my car on an a road, it's my fault because I couldn't stop! Two people asked me what brakes I had because I stopped so quickly! But now I've got to have people come and assess my car to see what I'm claiming for although I'm not claiming and then I've got to do a 2 and a half hour accident report with my insurance company to try and prove to them it wasn't my fault! I'm severely pissed off with elephant as this isn't the first time they've ripped me off in this exact way! Other was a woman who reversed into my car whilst it was parked and they said the manor in which I was driving may have contributed to the accident and duly charged me for it!
     
  7. Speak to a solicitor mate, sounds like they are taking the p1ss! If your not making a claim how can they take your no claims?
    You can normally get a solicitor that will give you half hour free and just see where you stand.

  9. No because I haven't got over 4 years ncb, hence if I loose my ncb the car will have to go! :worried:

  12. Admiral, bell and elephant are the same organisation. I'm interested to know if autoglass passed the information into the insurer?
     
  13. yer that's going to suck mate but they have opened a claim/reserved for their potential liability so you have an o/s claim on your policy.

    the problem is for the insurer, you say it's non-fault but a claim may come in (you have 3 years to claim or in a minor's case 3 years from their 18th) and considering that
    1. minor's get the sympathy of the court
    2. in pedestrian cases in general, even non-fault on the driver's part, you often can't escape liability in full. judges use the old 'you should have anticipated her running out into the road' (silly I know) and if you saw her prior to her running out 'you should have slowed down' in anticipation e.t.c
    3. witness evidence is key to denying liability. problem is if no claim comes in before your renewal it will be 'outstanding' and treated as a fault claim against the renewal. unless you get a physical admission in writing from the claimant before your renewal your a bit stuck.

  14. The windscreen people need to know what caused the damage before they'll do it but if you contact the company direct then they don't care. The guy who did mine changed a windscreen of a guy who had run someone down and killed them and he didn't ask questions! It's only when forensics came that he thought he should of mentioned it! And as far as my driving goes, I slowed down as the girls approached but she ran out so quickly I didn't have enough distance to stop. So I don't know where the fault lies even though the girl and her father have said it was her fault! I just want it resolved so I don't have to sell my car and get a heap of crap again!

    Any way as someone said earlier they are all the same company/ group and they have tried being pricks with me the moment a tiny accident occurred.
     
  16. I know mate, i was rear ended back in 09' and as it was an o/s claim it went against my renewal, just gotta suck it up im afraid

    i work for a motor insurer in claims by proffesion mate so if you need any advice in the future let me know

    Joking apart its a rock and a hard place, the is only one winner in this game unfortunately and it's the insurer that's why admirals turnover last year was 924 million!

  21. Yeah! If I can at least get my ncb then I'll switch over to a clio 200, turbo it on the sly and then get a meg 265 when I can afford it!
     
  22. It would just be great to have a company who doesn't put you in a generalised box if something happens to your car, it would be nice to find a company who look at your situation, not just sit there ticking boxes on a screen and then double the price of your insurance because they can!
     
  23. Thats why I have a top quality dash cam in all my cars. The footage will counter this 'anticipation' nonsence used by insurance companies to rouge their way out of paying out. If there was evidence that your standard of driving falling below what is expected, then the Police will prosecute for Due Care. No prosecution - no blame. I'd take it to the small claims court.

    Please don't "turbo your car on the sly", thats a very silly thing to do.

  27. Yeah I'm going with them next time, the only reason I'm with the heffalump w**kers is because I jumped up more than 100bhp and brentacre and greenlight wouldn't touch me, but they said they'd be happy to after a year!
     
  28. You realise brentacre and greenlight dont insure your car right, they broke for you?
     
  29. Yes. Greenlight (lv) were brilliant at handling a messy claim for me
